Whistleblowing expert says new law sets the bar high for EU

A new law to protect whistleblowers in France has made the country the 8th EU Member State to introduce new legislation to transpose the EU Directive on Whistleblowing.  Commenting on the new law, which reforms France’s previous whistleblowing framework known as “Sapin II”, whistleblower protection expert, Mr Jean-Philippe Foegle has published analysis on the new legislation -, The new French whistleblowing law: renewed hope for European whistleblowers?

The article examines the new legislation, also known as “the Waserman Law” named after the MP who introduced the Bill, and its aims to comprehensively protect whistleblowers, above and beyond the minimum standards of the Directive. Foegle also highlights the instrumental role civil society played in drafting and advocating for the new, more progressive, law.  

“This law, which implements EU Directive on the protection of reporting persons, goes further than the minimal standard set by the Directive to include international best practices, making it the most ambitious transposition in the European Union at the present time.” 

The deadline for all 27 Member States to fully transpose the Directive was 17 December 2021. The EU Commission has begun infringement proceedings against the majority of Member States who have missed the deadline.
