Following the adoption of new whistleblowing legislation to transpose the EU Directive on whistleblowing in February 2022, France has passed an additional decree to specify further details of the new legal framework.
The decree, passed on 4 October 2022, stipulates the external authorities whistleblowers can report to. The full list can be foundย here. The Directive requires the protection of whistleblowers when reporting directly to competent authority(ies) and imposes obligations on those bodies to protect the whistleblower’s identity and provide timely feedback.
NGO Maison des Lancuers d’Alerte have published a press statement stating calling the new decree โdisappointingโ and that the stipulations โsignificantly reduce the initial ambition of the (new whistleblowing) law, due to the limited number of designated authorities and key weaknesses in their capacity to fulfil their remit โ in particular, lack of power to investigate and sanction.”
