The Legislative Review Board in Finland has published an opinion on the Ministry of Justice’s draft Bill to transpose the EU Directive on Whistleblowing.
Finland is delayed in transposing the Directive which should have been fully implemented by the 17 December 2021. Many Member States are delayed and the Commission has begun infringement proceedings.
The‘Lainsäädännön arviointineuvosto’, which is an independent body which reviews draft legislation, has analysed the Bill and declared the draft law only partially complies with the guidelines for assessing the impact of legislative proposals. They have recommended the proposed legislation be clearer on the main impact on the rights and obligations of employees and employers.
The review also pointed out the draft Bill should be clearer on the impact of setting up new reporting channels in place of existing systems currently used by public authorities. Reducing the costs of implementing the Directive by integrating current reporting systems into new reporting channels was also recommended.
The Legislative Review Board states that the draft proposal be amended in accordance with the Council’s opinion before the Ministry of Justice submits its proposal.
