Denmark adopts new whistleblowing law

Denmark has adopted a new whistleblowing law.

The Whistleblower Protection Act passed on the 24th June 2021 makes Denmark the first EU Member State to adopt new legislation to implement the EU Directive on Whistleblowing. 

The law establishes a new whistleblowing reporting framework and protection from retaliation, which enter into force on the 17th December 2021, with certain provisions affecting employers in the private sector of between 50 and 249 employees being delayed until 2023.

The law had been delayed during consultation period due to conflicting opinions on the approach Denmark should take to implement the Directive. The Act widens the scope of the Directiveโ€™s minimum standards by protecting reports of serious wrongdoing and violations of national, as well as breaches of EU Law, which has been a key issue facing Member States required to transpose the Directive. Another issue for policymakers when transposing the Directive has been the provisions affecting larger group companies which the EU Commission is apparently currently reconsidering.
