New whistleblowing guidance published

The Government in Ireland has published new interim statutory guidance on whistleblowing to complement the new reforms of the whistleblower law.

The interim guidance for public sector employees and prescribed persons on the handling of reports made to them under the legal framework on whistleblowing.

The new legislation which is due to enter into force on 01 January 2023 introduces significant reform of the current 2014 Act. The new guidance will require public sector employers and prescribed persons โ€“ also known under EU Law and competent authorities โ€“ to strengthen systems to handle whistleblowing disclosures.

Minister McGrath said:

โ€œThis guidance will greatly assist public bodies in making the necessary preparations to get ready for the changes to the Act in the new year. It reflects not only the new requirements of the amended legislation but also takes on board a lot of feedback my department has received in relation to the operation of the legislation over the past eight years.

โ€œWhile this guidance is aimed primarily at the public sector, those private sector employers that will be required to establish internal reporting channels for their staff under the new legislation may also find some of the material in the guidance helpful.”
