Romaniaโs new whistleblowing law has now entered into force, as of 22 December 2022.
The previous whistleblowing law adopted in Parliament was subject to much criticism, resulting in the Romanian President sending it back to the Parliament for re-examination. Following several recommendations for revision from civil society, an improved version of the law was adopted by the Parliament on 13 December 2022.
There are still concerns regarding the new law. For example, the new criteria for anonymous reporting do not meet international best practice principles. Whistleblower protection expert, Radu Nicolae, believes โmore challenges lie ahead during implementation of this new framework.โ
Regulated entities under the law have to establish internal whistleblowing channels in 45 days after entering into force, before 6 February 2023.
The Romanian president promulgated the transposition law on 16 December 2022 and it was published on 19th of December 2022 in the Official Gazette.
