A whistleblowing law has been adopted in Romania to transpose the EU Directive on the protection of persons reporting breaches of Union law (2019/1937).
The legislation had previously been adopted in Romania but it was sent back to Parliament for reexamination by the president following concerns of significant flaws.
Despite calls from civil society for better provisions the law only meets the minimum standards required to transpose the Directive. In particular, the clause regarding anonymous reporting is regulated in a way that discourages the investigation of complaints. According to whistleblower protection expert Radu Nicolae, whistleblowers will be required to ” … provide “ground clues”, not merely information. This is expected to be used in practice to easily discard anonymous reports.”
The legislation will enter into force once the President promulgates the law.
