New proposal for whistleblowing law potentially adopts horizontal protection

The Ministry of Justice in Estonia has sent a detailed intention to transpose the EU Directive on whistleblowing to other ministries and relevant stakeholders for consultation.

 The intention foresees drafting a new horizontal law that would protect whistleblowers (or ‘reporting persons’) who report on any kind of offence, widening the initial scope of the Directive.

The document suggests that smaller local municipalities will also be obliged be set up (shared) reporting channels and that a separate reporting regulation should be developed in the areas of internal security and defence.

Transparency International Estonia’s which was invited to comment on the proposal has published its opinion online. All other feedback has been made available on the government website.

It is expected the Ministry will consider further public consultation on the draft intention in 2021.
