On 7 November 2024, the Minister for Finance signed S.I. No. 607/2024, which implements Regulation (EU) 2023/1114, known as the Markets in Crypto-Assets Regulation (MiCA).
This regulation amends the Protected Disclosures Act 2014. It adds Regulation (EU) 2023/1114 (MiCA) to the list of EU acts in Part II of Schedule 6, meaning whistleblowers who report breaches of MiCA are now protected under Irish law.
The regulation also designates the Central Bank of Ireland as the competent authority under Article 93(1) of MiCA and extends the Capital Requirements Regulations 2014 to cover new types of crypto-asset activities, including e-money tokens, asset-referenced tokens, and crypto-asset services.
This reform expands whistleblower protections to those disclosing misconduct in the rapidly evolving crypto-asset sector, bringing Ireland’s framework further into alignment with EU developments.
