A draft law to transpose the EU Directive on whistleblowing into Luxembourgish national law has been criticised by the Council of State for containing vague provisions. 13 formal oppositions to the Bill have been made, in a 22-page report on the proposed legislation. RTL Nieuws reports that:
โAccording to the Council, some points are vague or poorly written while other paragraphs are “superfluous.” It also fails to adequately protect civil servants and does not clearly specify when sanctions will be applied or how long personal data can be stored.โ
The official deadline for the Directive to be fully transposed was 17 December 2021. Luxembourg and several other of the 27 EU Member States are now over one-year delayed in transposing the Directive into their national legal systems.
