New provisions of the whistleblower protection law have come into force in Poland. Chapter 4 of the Whistleblowers Act – applying to external reporting to public authorities – entered into effect on 25 December 2024.
The Act requires competent authorities to introduce procedures for handling whistleblowing reports. This obligation extends to the Commissioner for Human Rights and a broad list of public authorities, including local government municipalities. The Ombudsman can receive reports from whistleblowers who are unsure which public authority to approach in order to assess and forward the information.
Poland was the last of the 27 Member States to adopt whistleblower protection legislation to transpose the EU Directive. The Whistleblower Protection Act was adopted on 14 June 2024, with other provisions entering into effect in September 2024. Public bodies responsible for receiving external reports were granted additional time to implement new procedures, until 25 December 2025.
