Media reports on Spain’s failure to implement whistleblowing rules

Spain has today missed the deadline to implement new legislation to adopt the EU Directive on whistleblowing into national law.

An article on Newtral reports that Spain may face infringement procedures and that the ministry of justice has not been transparent with the actions it has taken to produce a draft Bill. Several NGOs made a request for information at the end of November but it refused to share the proposal.

NGO Xnet have also pushed for the draft law to comply with the minimum standards of the Directive and also to meet international best principles for effective whistleblowing legislation. The Law has been officially registered in the Spanish Parliament.

A recent analysis by WIN and TI found that Spain was severely delayed in progressing implementation.  Denmark and Sweden’s new law comes into effect today with laws in Lithuania, Malta and Portugal also recently adopted.
