Germany’s Federal Council, the Bundestrat, has published an opinion on the draft whistleblowing law, known as the ‘HinSchG’, to transpose the EU Directive on whistleblowing.
The Bundesrat requests that several provisions of the law be examined, re-worded, and clarified during the further legislative process. In particular, representatives of federal states want to ensure that classified information at the federal state level is also predominately excluded from the law’s material scope of protection.
The EU Directive on Whistleblowing should have been fully implemented by all 27 EU member states by 17 December 2022. Infringement proceedings have been initiated by the EU Commission against governments that have failed to do so.
