The apparent hiatus in progress on the transposition of the EU Directive on whistleblowing into Belgium national law seems to be ending.
There has been little if any developments since Transparency International Belgium, who are monitoring the process, circulated its analysis of the Directive and recommendations for implementation of the Directive last summer.
Over recent months the Belgian Federal Government has pursued a two-pronged approach to the transposition of the Directive. The Minister of Economy has been developing projected legislation specifically for the private sector which would cover whistleblowing relating to fiscal and social fraud but not specifically mentioning corruption. This private sector related draft legislation has been sent to the Council of State for advice.
Meanwhile, Ms Petra De Sutter, Minister of the Civil Service, is working on a draft text of legislation to cover the public sector, which is now expected to be due in mid-April. If anticipated timing is realised, draft legislation to transpose the EU Directive for the public sector might be published by the end of May which suggests that the full legislative process may be completed during the autumn.
