Draft whistleblowing law submitted to Parliament

The Hungarian Government has finally submitted a proposal of a new law to transpose the EU Directive on whistleblowing to the current Parliament on the 28th of February 2023. The draft text was not previously published by the Government and there has been no information on any previous public consultations on this proposal.

Proposal Nr. 3089 takes a minimal approach to harmonisation, restricting the legal changes to what verbatim comes from the text of the Directive. The proposal plans to implement the Directiveโ€™s requirements by incorporating the Directiveโ€™s provisions into a new general legislative act on the handling of all public complaints: the office of the parliamentary ombudspersons will remain responsible for the operation of the independent mechanism to deal with public notices, whereas a new criminal offense protecting the whistleblowers from unlawful actions has also been proposed.

According to the planned agenda of the Parliament, the proposal will be discussed in March and early April 2023.
