The Advocate General of the Court of Justice of the European Union has issued an opinion on the complaint filed by the European Commission against Poland for its failure to implement the EU Directive on Whistleblowing.
In the opinion, the Advocate General has urged the Court to declare that Poland has failed to fulfil its obligations under the Directive.
Additionally, the Advocate General has proposed penalties, including a lump sum penalty of โฌ8,700 for each day of non-compliance since the deadline for transposing the Directive expired, totalling approximately โฌ7.1 million.
A further penalty payment of โฌ34,000 for each day of delay in complying with the obligations under the Directive has been suggested, amounting to โฌ3 million under the hypothetical assumption of a 90-day delay between judgment and the entry into force of the Act.
