NGOs Transparency International Italia and The Good Lobby have been monitoring transposition of the EU Directive on Whistleblowing in Italy.
Transparency International Italia published a statement urging the government to commit to focusing on introducing robust and comprehensive whistleblower protection legislation, rather than rushing to introduce law. The 17 December 2021 deadline for all member States to fully transpose has now passed. They urge for a transparent and inclusive consultation process to make sure the law will be robust and effective.
The process so far in Italy has been opaque. In January of this year, the national anti-corruption agency (ANAC) President said the transposition of Directive was a priority and he hopes it would be urgently completed. Whilst he announced a draft text of the law was available, there has been no hearings and no consultation on that proposal. Officially, the ANAC are not responsible for the transposition, yet it seems they have been working on the proposal.
A few weeks later, the Ministry of Justice addressed Parliament on the need to transpose the Directive. The Ministry was granted the official mandate to transpose the Directive for several months last year however they did not schedule any meetings or consultations and nothing has been published to date.
