NGO Xnet have sent a letter to the European Commission and to the Permanent Delegation of Spain raising concerns that the proposed translation of the EU Directive on Whistleblowing which jeopardises legal protections for whistleblowers. They have urged that for a correction be issued to remove any use of the term “denunciante” as the translation of “whistleblower” because in the context of the Spanish legal system, “denuncia” and “denunciante” have pre-existing legal meanings under Articles 259 to 269 of the Criminal Procedure Act. This approach would impose obligations which conflict with the provisions of the Directive. The proposal recommends instead the use of the the terms “alertador”, “alerta” and “canales de alerta” which would be more favourable to whistleblower protection and thus adhere to the tenet of the Directive which must be transposed into national law by the 17 December 2021.
