The European Commission has begun infringement proceedings against Luxembourg for failing to fully transpose the EU Directive on Whistleblowing. Infringement proceedings are the legal action the European Union can take against member states for failing to implement EU law.
The deadline for all 27 member states to transpose the Directive was 17 December 2022. Only a handful of countries have adopted legislation to implement the Directive into their national legal systems.
A letter of formal notice to initiate the action has been sent to 24 of the 27 member states according to information on the EU Commission website available here. Further information on the process of infringement proceedings, which eventually can see the issue being referred to the European Court of Justice, can be found here.
