NGOs send letter to EU Commission highlighting whistleblowing law failures

Anti-corruption NGOs have written a letter to the European Commission setting out concerns for Hungary’s new whistleblower protection law. 

NGOs Transparency International Hungary and K-Monitor set out in the letter dated 23 December 2023 that the new law excludes protection of whistleblower who report to them media – highlighting that this ‘clearly violates the whistleblowing directive.’ 

The letter concludes “… we deem indispensable that the European Commission examine Article 46(2) of the Whistleblower Protection Act whether it complies with EU principles and with Article 15(2) (on public disclosure) of the Whistleblower Directive. We hold that Article 46(2) of the Whistleblower protection Act contradicts Articles 15(1)(2) of the Whistleblower Directive and therefore it seriously endangers the European Union as an area of freedom, security and justice.”
